Trump FINALLY Gets What HE DESERVES as Judge TOSSES LAWSUIT!!!

Attorneys Brian Kabateck and Shant Karnikian break down an Iowa judge's dismissal of Donald Trump's lawsuit against pollster J. Ann Selzer and the Des Moines Register — a case Trump filed after winning the very state he sued over. Selzer's final pre-election poll, published days before the 2024 election, showed Kamala Harris leading Iowa by three points; Trump went on to win the state by more than 13 points, then hired lawyers in New York and Iowa to sue Selzer, the Register, and its parent company Gannett for consumer fraud, joined by Rep. Mariannette Miller-Meeks and former state Senator Brad Zaun. Brian and Shant explain the creative legal theory Trump's team tried: arguing that because newspapers sell subscriptions and ads, reporting the news is commercial activity rather than protected political speech, and therefore subject to Iowa's Consumer Fraud Act instead of the First Amendment. Iowa District Judge Scott Beattie rejected that argument in a ruling issued with prejudice, writing that "election polling is speech protected by the First Amendment" sitting "at the summit of the pyramid of First Amendment values," and pointedly noting that Trump himself had publicly dismissed the poll as "fake news" before the election — undercutting any claim that he was deceived by it. Brian and Shant tie this to Trump's broader pattern of media litigation, including dismissed or ongoing suits against The Wall Street Journal, The New York Times, The Washington Post, and the BBC, arguing the strategy isn't about winning but about forcing news organizations to spend hundreds of thousands of dollars defending themselves — a chilling effect on anyone tempted to report a story unfavorable to him. Brian's bottom line: Trump has now lost nearly every major media lawsuit he's filed, but the financial and psychological cost to the press of fighting them off is exactly the point.
