Brian and Shant trace the timeline: Trump's March 31, 2026 executive order directed USPS to build new mail-ballot rules; Judge Nichols initially dismissed a challenge in May as premature because the final rule didn't exist yet; but once USPS published its final rule in August, and with ballots already in voters' hands in states like Alabama, North Carolina, and Wisconsin, Nichols found the dispute was no longer premature and blocked it, ruling narrowly that the rule "exceed[s] any conception of the outer bounds" of USPS's authority under the Postal Reorganization Act. Brian and Shant note this follows a similar injunction from Judge Indira Talwani in Boston, upheld by the First Circuit, which reached the same result on constitutional grounds — that the time, place, and manner of federal elections belongs to Congress and the states, not the president. The Trump administration, now facing an emergency appeal at the Supreme Court on the Talwani ruling, has argued the rule is a "modest," purely logistical change, even as it requires USPS to withhold delivery of any ballot whose voter doesn't match a government citizenship list — with no appeal process and less than 60 days before the midterms. Brian's bottom line: this isn't a minor tweak to how the mail works, it's an attempt to let the executive branch decide who gets to vote by mail, and two judges — one appointed by Trump himself — have now said no.
