Trump's DOJ Election SCHEME BLOWS UP in His FACE!!!

Attorneys Brian Kabateck and Shant Karnikian explain why the Justice Department’s new lawsuit over Alaska’s U.S. Senate race faces a serious legal problem called ripeness. Filed October 22, eleven days before the November 3 election, the suit asks a federal court in Alaska to bar the state from certifying a win by Democrat Mary Peltola if independent Daniel J. Sullivan stays on the ballot, arguing his name could confuse voters and siphon votes from Republican Sen. Dan S. Sullivan. President Trump told reporters, “I’m the one that said do it.” The hosts note that the Alaska Supreme Court has already refused to remove Daniel J. Sullivan, that the ballot lists the senator as the “registered Republican” incumbent and his namesake with no party label, and that Alaska uses ranked-choice voting. Brian and Shant explain that a claim resting on “if” events, an election that has not happened and a margin that may be close, is not ripe, that the executive branch has no general authority over state elections without a grant from Congress, and that no remedy is workable short of asking voters what they meant, which would undermine the secret ballot. The DOJ relies on the preamble of the National Voter Registration Act, and legal experts, including Notre Dame’s Derek Muller and election-law scholar Rick Hasen, say it gives no such power. Cato Institute senior fellow Walter Olson said the suit borders on frivolous. The hosts predict dismissal and say the real purpose is to create material to question results if Republicans lose. Attorney General Todd Blanche has said DOJ does not intend to interfere improperly with certification. Brian’s bottom line: a lawsuit filed to challenge an outcome nobody has counted yet is a press release with a case number.
