Trump DOJ FIRES U.S. Attorney as They Try to DODGE Senate CONFIRMATION!!!

Attorneys Brian Kabateck and Shant Karnikian cover the Ninth, Second, and Third Circuits all reaching the same conclusion in the past week: the Trump DOJ cannot dodge Senate confirmation of U.S. Attorneys by endlessly relabeling loyalist appointees as "first assistant" once their 120-day interim terms expire. Brian and Shant focus on Seattle's Roger Rogoff, a respected former judge and prosecutor whom a bipartisan panel of federal district court judges unanimously appointed U.S. Attorney for the Western District of Washington on July 15, only for the Trump administration to fire him 54 minutes after he was sworn in. Rogoff has sued to be reinstated, arguing his removal violated the Constitution's Appointments Clause and the statute giving district judges, not the president, the power to fill the vacancy once an interim term lapses. Brian details why these rulings matter beyond politics: public defenders, not political opponents, are the ones bringing many of these challenges, because an unlawfully appointed U.S. Attorney can taint the underlying criminal indictments, the same theory that already got the Comey and Letitia James cases thrown out over Lindsey Halligan's unlawful appointment. Shant notes the DOJ keeps threatening Supreme Court appeals it never files, missing its deadline in at least one case already. Brian's bottom line: this scheme keeps losing in court, and it's putting real prosecutions at risk in the process.
